NELSON ROSS BOYLAN [#75899], 46, of Santa Clarita was suspended for nine months, stayed, placed on one year of probation with a 30-day actual suspension, and was ordered to take the MPRE within one year. The order took effect July 4, 1998.Boylan was employed as corporate counsel for two companies owned and operated by Gary Bandy.When Bandy separated from his wife, he retained an attorney in the state of Washington who associated with an individual who conducted electronic surveillance and illegal wiretapping of Bandy's wife.At one point, Boylan met with Bandy and his attorney and advised Bandy to destroy the tapes and pay off the individual who made them. By doing so, Boylan advised Bandy to engage in criminal conduct which could violate the Washington criminal code.In mitigation, Boylan's statements appear not to have been acted upon, and therefore produced no specific harm. When he learned that he was the subject of a criminal investigation, he cooperated with the U.S. Attorney in Seattle and with the FBI in Los Angeles. He also cooperated with the bar's investigation.He has no record of discipline in 20 years of practice.
