Daphne Lori Macklin [#117189], 62, of Sacramento, was suspended Dec. 8, 2017, for 90 days and placed on probation for three years. She must provide proof of passage of the Multistate Professional Responsibility Examination. She must make restitution of $2,775 to two clients. She must obtain psychiatric or psychological treatment. She must initiate fee arbitration regarding a dispute with one client and comply with the outcome. Macklin stipulated that in one client matter she failed to perform with competence when she did not respond to the opposing party’s discovery requests or motion to compel discovery and impose sanctions, along with other litigation steps. She effectively withdrew from employment by that client and failed to respond promptly to about 30 telephonic status requests. She held herself out as entitled to practice law while she was not an active member of the State Bar. She failed to cooperate in the resulting disciplinary proceeding. She similarly withdrew from employment without the permission of the court or otherwise failed to perform the services for which clients had retained her in two other client matters. She was placed on ineligible status due to Minimum Continuing Legal Education non-compliance. In another client matter she failed to appear in court. In 2013 Macklin and her significant other were involved in a physical altercation. She then progressively lost the ability to manage her law practice. She failed to respond to clients, the courts and the State Bar. In 2016 she sought psychotherapy and was diagnosed with post-traumatic stress disorder and depression. In aggravation, she committed multiple acts of wrongdoing. In mitigation, she practiced law for about 29 years without discipline. She submitted character letters and a declaration attesting that her misconduct resulted from the effects of an abusive home life and subsequent mental health crisis.
