LISA IRENE FOCHETTI [#171954], 34, of Santa Rosa was disbarred July 31, 2005.

Fochetti failed to comply with rule 955, as required by a 2003 disciplinary order imposed following a misdemeanor conviction for spousal battery. She did not file with the Supreme Court an affidavit stating that she notified her clients and other pertinent parties of her suspension from practice.

She did not participate in the disbarment proceedings.

LISA IRENE FOCHETTI [#171954], 33, of Modesto was suspended for one year, stayed, actually suspended for 30 days or until the State Bar Court grants a motion to terminate the suspension, and was ordered to take the MPRE. If the actual suspension exceeds 90 days, she must comply with rule 955; if it exceeds two years, she must prove her rehabilitation. The order took effect Dec. 4, 2003.

In a default proceeding, the State Bar Court found that Fochetti’s 2000 conviction for domestic violence warranted discipline.

A former attorney for the Kings County District Attorney’s Office, Fochetti argued with her husband over two days when he tried to take away her gun and her car keys. Fochetti’s doctor had instructed her husband to take away his wife’s firearms for her safety. During the argument, she bit her husband’s right shoulder.

Fochetti’s husband told police his wife had a drug problem and had left a rehab program without permission.
