December 15, 2017
Benjamin Tyler Brandt [#201506], 45, of San Diego, was suspended Dec. 15, 2017, for 60 days and placed on probation for three years. He must provide proof of passage of the Multistate Professional Responsibility Examination. The State Bar Court Review Department affirmed a hearing judge’s finding that Brandt committed approximately 100 acts of the unauthorized practice of law in federal bankruptcy court by filing bankruptcy petitions while not admitted to practice before the U.S. District Court for the Central District of California. He showed an unreasonable lack of attention to the bankruptcy court’s admission requirements. In aggravation, he committed multiple acts of misconduct and showed indifference by his seemingly refusal to accept the findings of the bankruptcy court. In mitigation, Brandt submitted letters attesting to his good character and the bankruptcy panel did not find that he knowingly committed UPL.
