SHAWN MICHAEL HAGGERTY [#219231], 53, of Hacienda Heights was suspended for two years, stayed, placed on two years’ probation with an actual 60-day suspension and ordered to take the MPRE and pay restitution. The order took effect March 1, 2014.Haggerty stipulated to five counts of misconduct in one client matter. In 2011, a woman hired him to represent her in filing petitions for expungement of several criminal convictions. Despite being paid $1,500 to do so, Haggerty performed no services of value on the woman’s behalf. After the woman tried for more than a month to reach Haggerty to get a status update, he texted her back claiming that he had filed the petitions and the process would take six to eight weeks. Between Nov. 10, 2011 and May 10, 2012, the client contacted Haggerty repeatedly for an update with little success. Finally, she went to the courthouse where Haggerty said the petitions for expungement were pending, and learned they had never been filed.Soon after, the woman fired Haggerty but did not receive her file from him until August 2012 after the State Bar had begun an investigation.Haggerty stipulated that he failed to perform legal services with competence, failed to respond promptly to a client’s reasonable status inquiries, made a false statement to his client, did not refund unearned fees and failed to promptly release the client papers and property. He was ordered to pay $1,500 plus interest in restitution.In mitigation, Haggerty entered into a pretrial stipulation with the State Bar, had no prior record of discipline, has done a substantial amount of pro bono work and volunteers for charitable organizations.
