John Darwin McCurdy II [#54091], 73, of Goleta, was disbarred Nov. 3, 2017, and ordered to notify his clients of the discipline and perform other obligations under rule 9.20 of the California Rules of Court. McCurdy stipulated that he had pleaded no contest in 2015 in Santa Barbara County to two misdemeanors: carrying a concealed and loaded firearm in a vehicle and driving with a blood alcohol concentration of 0.08 percent or higher. In aggravation, McCurdy had been convicted in 1994 for gross vehicular manslaughter while intoxicated and of a DUI causing bodily injury after he caused an auto accident resulting in the death of one victim and injury to four family members. He had been sentenced to six years in state prison and had a prior DUI conviction from 1985. That misconduct was mitigated by the facts that his insurance had paid the victims $1.35 million, that he was receiving psychotherapy and that he was participating in AA. His misconduct was mitigated by entry into a pre-trial stipulation.

JOHN D. McCURDY II [#54091], 53, of Newhall was suspended for four years, stayed, and placed on four years of probation with an actual two-year suspension and until he proves his rehabilitation and passes the MPRE. The order took effect Feb. 6, 1997, but the actual suspension was retroactive to May 1, 1995.McCurdy pleaded no contest to three felonies in 1994 after he caused an automobile accident resulting in the death of an 11-year-old and injuries to four family members. His blood alcohol level exceeded .20 percent at the time. He was sentenced to six years in state prison and was placed on interim suspension by the State Bar May 27, 1995. McCurdy had a previous DUI conviction in 1985. In mitigation, his insurance carrier paid the victims $1.35 million, he began psychotherapy, and he has joined AA in prison.
