ERNEST GEORGE GEORGGIN [#60293], 68, of San Diego was disbarred March 3, 2014 and ordered to comply with rule 9.20 of the California Rules of Court and make restitution.

Georggin stipulated to misconduct in 25 matters including: aiding in the unauthorized practice of law; lending his name to be used by non-attorneys engaged in the unauthorized practice of law; accepting employment in a state where he was not authorized to practice law; entering into an agreement for, charging and collecting fees in a state where he was not authorized to practice law; abdicating his law practice to non-attorneys; sharing fees with a non-lawyer; and failing to perform legal services with competence return unearned advanced fees or cooperate or participate in a State Bar investigation.

In August 2010, Georggin and non-attorney Eric Phillips formed Georggin Law to perform credit repair services. Georggin completely turned over the practice to Phillips and other non-attorneys and had no authority over its operations, including whether or not to accept a new client on behalf of the firm. Georggin also had a stamp of his signature made that the firm’s non-attorneys used to conduct business transactions.

The clients paid the firm advanced fees for credit repair services but provided no services of value to at least 25 of them. In one case, the firm agreed to do work on behalf of a resident of Florida, where Georggin is not admitted to practice. Around June 2013, Georggin closed the firm, taking control of at least 650 client files. As of the date of his stipulation, he had not refunded any portion of the attorney’s fees.

Georggin was ordered to pay $90,061 plus interest in restitution.

In mitigation, Georggin had no prior discipline and cooperated with the State Bar by entering into a pretrial stipulation.
