Darryl Wayne Genis [#93806], 61, of Santa Barbara, was suspended Dec. 29, 2017, for 60 days and placed on probation for two years. The State Bar Court Review Department held that during a DUI trial in 2014, in which Genis represented the defendant, Genis “fiddled” with a prosecutor’s papers during a court recess and then rearranged and hid a document from him. The prosecutor reported this to the trial judge, who asked Genis four consecutive questions regarding whether he touched, moved or hid any documents. Genis denied the allegations. The judge later reviewed courtroom videotape that revealed that Genis did what he denied doing. The review department held that Genis sought to mislead the judge, an act involving moral turpitude. In aggravation, Genis had one prior record of discipline for violating court orders. He caused significant harm to the administration of justice. The review department assigned minimum weight to his pro bono activities and community service.
