GERALD WILLIAM FILICE [#99657], 57, of Sacramento was suspended for two years, stayed, placed on two years’ probation with an actual 60-day suspension and ordered to take the MPRE. The order took effect Nov. 28, 2013.

Filice stipulated that in 2011 he agreed to represent clients in a defamation case without first informing them that he did not have professional liability insurance, even though he knew that his work for them would exceed four hours. He also failed to file a response when a disciplinary complaint was lodged against him with the State Bar.

Separately, Filice failed to abide by the terms of a 2011 disciplinary order by not contacting the Office of Probation to schedule a meeting with his assigned probation deputy within 30 days of the effective date of discipline. He also did not submit three quarterly reports to probation, did not provide proof of attendance at Ethics School and Client Trust Accounting School by the required deadline, did not provide proof of passage of the MPRE on time and did not submit client funds quarterly reports with a certificate from a certified public accountant or other financial professional on time.

Filice’s previous discipline was a 2011 public reproval for commingling. Specifically, between August 2010 and May 2011 he failed to withdraw his personal funds from his trust account, used his trust account for personal purposes, made 12 payments from his trust account for personal expenses and repeatedly deposited his personal funds into the trust account.
