KRISTIN LYNN DAY [#269679], 35 of Roseville was disbarred April 23, 2014 and ordered to comply with rule 9.20 of the California Rules of Court and make restitution.Day stipulated to misconduct in nine matters: aiding a person or entity in the unauthorized practice of law, lending her name to be used as attorney by another person who was not an attorney, forming a law partnership with a non-lawyer, sharing fees with a non-lawyer, the unauthorized practice of law in another state, committing acts of moral turpitude and failing to perform legal services with competence or return unearned fees.The charges stemmed from a partnership Day started with a non-lawyer called United Foreclosure Attorney Network, which purported to provide mortgage litigation and other debt-related services to borrowers and property owners. Day was not involved in the decision whether to accept new clients. Instead, non-attorney legal assistants took on that role and provided legal advice without attorney supervision. Clients paid upfront fees but received no services of value.Day was ordered to pay $41,578.50 plus interest in restitution.In mitigation, she entered into a prefiling stipulation with the State Bar and presented evidence of her good character.
